Transfer of Undertaking Protection Employment Law Update
Can you answer the following questions correctly?
- TRUE/FALSE: You have just won a new contract from your main competitor. He has now told you that you must employ all of the staff he formerly employed on the contract.
- TRUE/FALSE: A member of staff transferred to you under TUPE. Before he transferred he was injured at work. He now says he is going to pursue a claim against you for the injury.
- TRUE/FALSE: Staff transferred to you under TUPE from a local authority. Before they transferred their pay was fixed each year under a national agreement. They now say that you must honour any future pay increases that are set.
