Parties are free to negotiate and consider all of the options available to them without being bound by decisions until independent legal advice has been provided on any final agreement.

The mediator does not provide legal advice but can advise on the law. The mediator acts impartially helping people to make decisions that work best for them. Mediation can be engaged at any stage and it can achieve an early agreement about a specific issue or deal with all implications of separation.

During the mediation process, either party can seek ongoing legal advice alongside the mediation. If an agreement is reached solicitors will draft this agreement to form a Consent Order. Even if mediation does not resolve all the issues, it can still help narrow disputes between the parties.
