Children and Domestic Violence

If there has been violence or abuse in a relationship, or if there are problems involving children, you may need to involve a court on an emergency basis. It might be necessary to seek protection from a partner or former partner. We understand these problems and can help you get that protection quickly by way of an injunction or police assistance, often the very same day as the need arises. We are able to draw upon many years of experience which allows us to provide quick and accurate advice for every possible emergency.

Through the contract with the Legal Aid Agency we are able to grant immediate Legal Aid to those on a low income, provided the circumstances warrant it. This means, in most cases where emergency action is required, we are able to issue proceedings the day we receive your instructions.

Children Matters

We have extensive expertise in cases where an instant response is needed, such as:

• domestic violence

• threatening and harassing behaviour

• exclusion from the family home

• domestic child abduction

• prevention of abduction

• allegations of neglect or violence involving children

• interim financial arrangements

If you need immediate and urgent advice, we will ensure that the earliest possible appointment is made available. All of our understanding and sympathetic team can offer instant assistance. We will provide representation at any type of court hearing, tribunal or meeting involving professionals, such as the police or the Social Services Department.

Legal Aid is available if you need to make an application to the Court for an Order for protection of yourself or your children, provided that you meet the criteria set down by the Legal Aid Agency.

For applications regarding children, Legal Aid is only available in very limited circumstances where there is evidence that there has been domestic abuse from the other party or there is a requirement to protect children from the other party involved in the proceedings. We will be able to advise you further as to the availability of Legal Aid when you telephone us.
